美国法律术语翻译参考
二、在不会造成歧解的情况下，译文尽可能使用通俗语言（例如套用国内法律术语），例如statutes and laws只译作“法律”，而不是“成文法和惯例法”，也并不逐字逐句直译，例如file an application for a Court order(“application”)中括号内的文字，又如对法律条文的引用（50 U.S.C.§ 1803(g)译成《美国法典》第几章第几节第几条对普通读者毫无意义，反而不方便有兴趣的读者查阅有关法律条文、专业人员引用），同理1806(k)连用时不处理为第1806条第11款，甚至保留(a)等美式序号而不是处理为汉语序号（比如说第一款）。
三、美国法律术语并没有完整而权威的译文，为此，译者将可能存在不同译法的术语汇编如下，不在正文中第一次出现时附原文，以便阅读和检索。需要加以注释才能防止歧解的术语，包括表面上可能是普通语言实际上却是术语的措辞，如“美国人”（a United States person）；未在此处汇报的部分专有名词和术语在第一次出现会附上原文（包括绝大多数人名）。容易望文生义或错误理解但不影响专业人员的术语不进行通俗处理，也不加解释，如“救济”（relief，不处理为比如说“赔偿”，司法救济在国内已是通用术语）。
adversary proceeding 对质式诉讼；在大多数普通法国家中，双方当事人在这种诉讼中承担发现并展示证据的主要责任，独立的法官不调查事实（参见《朗文法律词典》第六版）adversary hearing 对质听证会，指双方当事人出庭辩论 affirm 维持（原判决或裁定、原命令、原指示）
affirmation 不以宣誓方式表述的确认（证词）；on oath or affirmation以宣誓或郑重保证的方式 affidavit 誓书；在公证人或其他获得授权的官员面前宣誓，从而提供的书面证词
a foreign power：外国势力（通译就是外国），在《对外情报侦察法》中具有特定含义：外国政府；外国政府的外交官、其他代表或雇员；主要不由美国人构成的某个外国的一部分；外国政府公开承认受其指导和控制的某个实体；参与国际恐怖主义或为此而准备的活动的团体。
amici curiae（amicus curiae）法庭之友；自愿向法庭就其审判的案件提供信息的非诉讼当事人 appeal 上诉 appear 出庭
application 申请；应用 arguendo 为了方便辩论起见
attorney 律师；若系美国司法部工作人员译作“检察官”；Legislative Attorney译作“国会律师” a United States person美国人，根据《对外情报侦察法》，其定义为美国公民，可以合法常住美国的外国人，大量成员为美国公民或可以合法常住美国的外国人的非法人团体，美国法人。authorization 授权；reauthorization；再授权；涉及美国政府预算时，其意义近于拨款 brief 申述，书面提交法院阐明一方提出的事实和法律论点的简报 cause of action 案由（提起诉讼的理由），以任何理由起诉 challenge 质疑（性质上就是我国法律制度中的上诉或申诉）
claim 主张（涉及权利的要求，新华社目前将涉及主权的主张一般译作“声索”）clerk 文书处（机构）；法官秘书 Court of Review复审庭
cross-referencing 前后参照；即援引先前的案例 defense 辩解（辩护理由）
deny 驳回；否决；注意：dismiss一般也译作驳回或否决，两者同时出现则其中之一译作否决。directive 指示
disclosure 披露；指有关情况的公开，包括政府掌握的信息向法院通报、政府内部涉密和涉及个人隐私的信息的扩散、政府要求比如说银行或电信公司向其公开客户信息的情况；法院或政府向国会提供相关文件；Prohibition on Disclosure即禁止相关信息的披露（公开或扩散）。docket 案卷
en banc 全体法官（参与的审理）
Executive Branch 行政分支，其实就是以总统为首脑的政府，相对国会和法院而言 Ex Parte 单方面；指无需知会另一方当事人的活动
hearing：预审；rehearing：复审；注意：两者均为美国法庭审判用语
minimization procedures 起码程序（字面含义：最低限度的程序）；旨在尽可能减少截获、保留和传播的信息；单用minimization时大致译作“尽可能减少”或“最低限度”。
motion 诉求（在美国法律中，motion特指与法院的命令或裁决有关的application，后者在本文中译作“申请”）；motion to suppress：查禁诉求（指不得公开或在诉讼中使用截获信息的诉求；suppress单独使用时亦作查封）；discovery motion，知情诉求（要求了解情况的诉求；discovery单独使用时亦作告知）。
multipoint or roving wiretaps 多点或漫游窃听
national security letter 国家安全函，美国联邦调查局所使用的一种行政传票，要求受令实体提供有关个人的信息和数据，使用这种传票不需要probable cause（释义见下文）或司法监督，据说中央情报局和国防部等机构也使用这种传票；national security letter authorities一般译为“国家安全函签发权”。
non-compliance 不服从行为（不服从法院令或法律）
nondisclosure 保密（指不得泄露有关情况）；nondisclosure order，保密令 nonfrivolous 重要（的）opinion 判决陈述；在memorandum opinion and order（意见和命令备忘录）中译作“意见”；在美国其本意是法院或有判决权的机构对其结论（判决或裁定）陈述法律理由和原则的那部分文字；单独使用时也译作“意见”或“意见书”。order 法院令，法庭令；命令 particularity 特殊性
party 当事人，诉讼中的一方，在这里就是美国政府或其监视对象
pen registers 电信记录仪；直译为“笔式记录仪（器）”。据维基百科，它最初指的是在纸带上记录电报信号的设备（1840年），后来广泛用于记录脉冲电信号；在美国执法界，它指的是记录在特定电话线上的所有呼叫号码的电子设备，但现在指功能类似的任何设备或程序，包括监视因特网通信的程序。在这部法律中的定义见18 U.S.C.§ 3127。petition 申诉
petition review pool 申诉复审组（《对外情报侦察法》法庭术语，指有权重审特定案件的法官）physical search 实地搜查 physical surveillance 实际监视
pleading 诉状（包括起诉状、答辩状，与我们的概念不完全相同）
plenary review 合议重审，即de novo，其实就是重审：在美国法律制度中指上级法院独立审案，不必考虑先前的判决；在中国法律制度中，合议只是为了防止个人审理案件可能出现的错误。plurality decision 多数裁决（在判决书或裁定书中的多数法官的意见）private right 私权；private right of action 私人诉权。
proceeding 诉讼（泛指或涉及原告和被告双方或一方）；审理（从法院角度而言的工作）production 出示（证据；如向政府提供相关档案、记录、文件）
property or premises 房地产；前者指房屋及其周边的土地（属于同一业主），后者也是，两者的区别一般说来在于前者强调的是住所，后者强调的是经营或办公场所；前者的外延更大，如50 U.S.C.§ 1824(c)中的表述the nature and location of each of the premises of property to be searched所示。property亦译作财产（如在the residences, offices, or personal property of United States persons的表述中）。
probable cause 令人信服的理由，充分的理由；虽然现在有“高度或然”的说法可能就是从probable衍生出来的，但它尚不能算是标准术语，而且不如直接说成是“可能性极大”（“高度或然”本身就是畸形汉语）；全篇未统一。
proposed applications初步申请（可以理解为经办人员提出的申请，而最终申请[final applications]是比如说由司法部长签发申请，其中提出政府的最终要求）proposed orders 拟制命令（可以理解为代法庭草拟的命令，法庭可能在完全认可的情况下照样发出法院令，在部分认可的情况下修改后发出相应的法院令，在不同意的情况下仅仅将其归档）physical intrusion 实际干扰，干扰在这里指身体接触（如搜身）和闯入对象居住或办公场所（有类于抄家）。
relief 救济，即依法纠正或得到补偿
remand 发回重申（修改）；上级法院推翻下级法院判决、裁定、命令后的一种处置方式
reproduce 再现；涉及实地搜查的术语，未查到权威诠释，从逻辑上推断，对信息、材料或房屋（information, material, or property，50 U.S.C.§ 1824）的再现就是复制，只不过在汉语中“复制”房屋（房地产）会引起歧解（令人首先想到的是仿造，实际上很可能是用制图或照相的方式“复制”，甚至用的是文字），在英语中没有这个问题，所以统一为“再现”。response 回应（此处是一种用于复审的法律文书）return 回复（法律术语，报告的一种形式）reverse 推翻（判决、命令等）
statement 诉状（在法律文件中，否则，通译为陈述或声明）
submission 文档，根据“程序规则”第七条，包括申请、证明、申诉、诉求或其它文件；无歧义或者不与file或filing并列时亦译作“文件” subpoena 传票
subpoena duces tecum 传召令；译注：法院用于传召某人携带指定文件出庭作证的命令 Sunset Provision 日落条款；译注：在规定日期自动失效的条款
sur-reply 再回复，如一方提出诉求，另一方回复，诉求方回应，此时法庭可能允许另一方提出再回复。
tangible things，有形事物，直译也可以是“实物”，在这里有其特定含义，指文件、记录、档案、账册和凭证，因此，笼统译为“账簿”。
trap and trace devices 捕获和跟踪装置（电信设备，因此，捕获和跟踪的是电子信号）wall：直译为“墙”，指有意隔离正常的刑事侦查和针对外国的情报工作的法律 warrant 令状；搜查证、逮捕证等，法院命令的一种，在这里包括准许监听的法院命令；warrantless，无令状的（地）；有时直接译作搜查令。
writ of certiorari 复审令（用于上级法院调取下级法院的案卷）；单用certiorari时，直接译作上诉，因为在中国绝大部分上诉案件的审理也是对案卷的审理。the Chief Justice 首席法官（可以理解为美国最高法院院长）Presiding Judge 庭长
特别说明：
In re Sealed Case 即In re Sealed Case, 310 F.3d 717(2002)或In re: Sealed Case No.02-001，即美国《对外情报侦察法》复审庭因政府上诉而审理《对外情报侦察法》法庭的2002年5月17日判决（2002年11月18日裁定）的案件称谓（后面的数字是序号），在国会研究署报告中大致处理为“在这个上诉案件中”并附上原文。这份报告还谈到的In re All Matters Submitted to the Foreign Intelligence Surveillance Court实际上就是《对外情报侦察法》法庭的2002年5月17日判决，当然可以直译为“兹就向《对外情报侦察法》法庭提出的所有问题作复”，但显然不如处理为《对外情报侦察法》法庭的2002年5月17日判决并附上原文合适：一般专业人员不必为仅出现一次的术语伤脑筋，需要进一步研究的专业人员不难从所附原文上搜寻到更多资料。
USA PATRIOT Act：“美国爱国者法”（俗称，正式名称是the United and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism Act，“通过提供防止和阻止恐怖主义所需的合适手段而团结和增强美国法”），其实应该译作“美国爱国法”，但只能从众了。注意：第107-56号公共法律是其同义词。

简介：《美国法典》2006年版共50编（title），实际上只有49编（第34编“海军”已被取消），每编对应于一个主题，只有23编是positive(statutory)law（其文本成为legal evidence of the law），其中不包括第50编“战争与国防”（其文本只能作为prima facie evidence of the law；《对外情报侦察法》是其中第36章的标题）。中国法律的排序自然无法与美国法律对应，但国内缺乏权威翻译，局面混乱。如人们相对熟悉的有关贸易的“超级301条款”（Super 301，实际上是《1988年综合贸易与竞争法》的Section 302）就是例子：即便按国内法律的排序惯例和标准，“条”、“款”不能并举（因为“条”之下才是“款”）。因此，以下提供美国法律序号的中英文对照文本，旨在至少保证这套资料中的译名实现统一。此外，美国法律的序号会夹杂字母和数字，如果译出时则取上一个序号，如Section 501(f)译作第501(f)节，不是第501节第f（6）条（原文严格排序也未必是“条”）；在引用的情况下一律使用原文，如50 U.S.C.§ 1821(4)。
注意：在《美国法典》系统之外，也会用到title（编），如《对外情报侦察法》也被称为第95-511号公共法律第一编；甚至可能将section称为title，如在“对《对外情报侦察法》的修改”一文中。为了全篇统一，类似于the new Title VI of FISA译为“新的《对外情报侦察法》第六编”，在“pursuant to this title(Sec.305 of FISA)”这样的情形中还是译为“根据此编”。特此说明。title编
