1.1 电子商务的内涵

电子商务(E-conmmerce)是通过电子化手段来完成商业贸易活动的一种方式。具体的说,电子商务以开放的因特网环境为基础,进行商品和服务的买卖,资金的转账,以及公司间和公司内利用电子邮件、电子数据交换、远程计算机联网等所能实现的全部功能。一般有企业对企业(B2B)年和企业对消费者(B2C)两种,另外还有消费者对消费(C2C)这种正在逐步增长的模式。

1.2.2 应对责任风险的电子商务保险

一般的,责任风险是个人或团体业疏忽,过失造成他人的财产损失或人身伤害,根据法律规定或合同约定,应负经济赔偿责任的风险。在电子商务领域的主要表现如下:

(1)物流企业对买方卖方的责任。第三方的物流产生了物流企业对买卖双方的责任,这一责任需要得到相应保险的保证,否则物流行业存在的风险过大,在一定程度上有碍于物流业的专业化发展。

(2)网络信息安全的责任。电子商务交易中存在着信息的交换,信息的需求方对提供人存在着保障其信息安全的责任,相关的保险产品可以促使该责任的落实。

1.2.3 应对信用风险的电子商务保险

一般的,信用风险指在经济交往中,权利人与义务人之间,因一方违约或违法给对方造成经济损失的风险,这一风险在电子商务中尤为突出。在电子商务领域,有如下表现:

(1)对于卖方,存在着买方拒接签收以及拒接付款的风险等。目前,淘宝网上已经出现了拒不签收险,以保障卖方的利益,但在推广实行中还存在着难度。

(2)对于买方,存在着卖方不发货的风险以及货物与描述不相同的风险等。该风险成为限制电子交易发展的重要原因,相应保险的保障能极大地增加买方的信任感。

(3)对于买卖双方来说,物流行业的信用也需要得到保证。我国电子商务保险的发展与现状

现阶段,电予商务保险还处于初级阶段,险种很少,受众有限,保险公司对电子商务保险的开发也还处于试验阶段。

值得注意的是,2010年,华泰保险推出了一款为淘宝网量身打造的网购退货运费保险。在买家或卖家投保以后,一旦发生网络购物退货风险,损失的退货运费将由保险公司买单。卖家的保费将按照卖家前3个月的退货率确定,如果退货率在0.5%以下保费为0.1元,退货率为0.5%~1%保费为0.2元,依此类推,买家缴纳的保费是按赔付金额的5%收取。

这款保险目前仍处于初步试验阶段,保险产品的设计还不够完善,比如,该保险产品现在实现的是“收费按货物件数,赔付按快递包裹数”的规则,这确实有助于防止道德风险,遵守了保险的损失补偿原则,但却造成了消费者给付保费时的损失。并且,该保险产生的道德风险与逆向选择问题较为严重,在给买家提供利益保障的同时也给一些卖家带来了困扰。同时,现有的保费计算方法还过于简化,考2

虑到电子商务保险的专业性,它在精算定价方面实则比传统的保险产品有更高的要求。

由小见大,我们进一步分析我国现阶段电子商务保险发展的现状:

2.1 我国的电子商务发展迅猛,但基础较为薄弱

我国的电子商务起步较晚,但据不完全统计,截至2008年上半年,我国互联网用户已迅速增长到2380万户,位居全球第二,国内电子交易额在近四年内连续翻番。

在美国,企业的商务需求“推动”了网络和电子商务技术的进步,当Internet时代到来的时候,美国已经有了一个比较先进发达的电子商务基础。而中国,网络和电子商务技术不断拉动企业的商务需求,进而引致中国电子商务的应用与发展。因此,电了商务在我国的发展动力存在着一些不足,特别是我国企业间与企业内的电子商务。

但是,以淘宝网,卓越网,当当刚为代表的电子商务平台取得了显著发展。该模式的电子商务交易量大,单笔交易额较小,是适应中国国情的发展方向。但这也对相适应的电子商务保险的设计提出了较高的挑战。交易双方的信用不易评估,评价的工作量大,成本高。

另一方面,物流是电子商务的重要组成部分。美国在定义电子商务概念之初,就有强大的现代化物流作为支持。而我国的物流业起步晚,水平低,在引入电子商务时,并不具备支持电子商务活动的现代化物流能力。现阶段,我国的物流行业已经有,迅猛的发展,物流公司不断涌现。但是,物流的专业化仍然不足,成本高,速度慢,运输货物毁损等问题仍然困扰着消费者。
