一、***学院聘请***为英语教师。双方本着友好合作精神，自愿签订本合同并保证认真履行合同中约定的各项义务。

二、合同期自2016年1 月10日起至2017年12月31日止。

三、乙方的月薪为人民币8600元。甲方提供乙方一居室住房，若甲方不能提供住房，每月租房补贴2000元。

四、甲方的义务：

1.向乙方介绍中国有关法律、法规和甲方有关工作制度以及外国专家的管理规定。

2.对乙方的工作进行指导，检查和评估。

3.向乙方提供必要的工作和生活条件，协助乙方办理各种手续，包括居住证和专家证等。

4.按月支付乙方的报酬和乙方在职期间1次往返机票。5.若法规许可，为乙方购买《人身意外伤害保险 》并附加《意外医疗保险》。

五、乙方的义务：

1.遵守中国的法律，法规，不干预中国的内部事务。

2.遵守甲方的工作制度和有关外国专家的管理规定，接受甲方的工作安排，业务指导，检查和评估，未经甲方同意，不得兼任与甲方无关的其他劳务。

3.完成每周16节课时要求、参加英语角等课外活动和指导学生参加各种英语竞赛。按要求制定相应的教学计划和教学内容，事先交甲方审定，并按指定的时间和地点上课。按期完成工作任务，保证工作质量。在教学过程中，经甲方同意，乙方可适当调整教学计划或内容。乙方根据教学需要补充的教材、资料等，应经甲方同意，方可使用。当甲方对乙方进行教学评估时，乙方应予以合作。

4.尊重中国的宗教政策。不从事与教师身份不符的活动。不在学校和学生中宣传宗教。

5.尊重中国人民的道德规范和风俗习惯。

六、合同的变更，解除和终止：

1.双方应信守合同，未经双方一致同意，任何一方不得擅自更改、解除和终止合同。

2.经当事人双方协商同意后，可以变更，解除和终止合同。在未达成一致意见前，仍应当严格履行合同。

3.甲方在下述条件下，有权以书面形式通知乙方解除合同：

(1)乙方不履行合同或者履行合同义务不符合约定条件，经甲方指出后，仍不改正的;

(2)根据医生诊断，乙方在病假连续30天后不能恢复正常工作的;

4.乙方在下述情况下，有权以书面形式通知甲方解除合同;

(1)甲方未按合同约定提供乙方必要的工作和生活条件;

(2)甲方未按时支付乙方报酬。

七、违约金：

当事人一方不履行合同或者合同义务不符合约定条件，即违反合同时，应当向另一方支付20000元的违约金。

乙方因不可抗力事件要求解除合同，需出具有关机构证明，经甲方同意后，离华的费用自理;乙方若无故解除合同，除离华费用自理外，还应当向甲方支付违约金。

甲方因不可抗力事件要求解除合同，经乙方同意后，离华费用由甲方负担;甲方若无故解除合，除负担乙方离华费用外，还应当向乙方支付违约金。

八、本合同自双方签订之日起生效，合同期满即自行失效。当事人一方要求签订新合同，必须在合同期满30天前向另一方提出，经双方协商同意后签订新合同。

乙方合同期满后，在华逗留期间的一切费用自理。

九、仲裁

当事人双方发生合同纠纷时，尽可能通过协商或者调解解决。若协商，调解无效，可向国家外国家局设立的外国文教专家事务仲裁机构申请仲裁。

本合一式两份，每份都用中文和英文写成，两种文本具有同等法律效力。

第五篇：聘请外教手续

聘请外国专家单位资格

一、许可事项：聘请外国专家单位资格认可

二、实施机关：国家外国专家局

三、受理机关：省人事厅（省外国专家局）

委托受理机关：市人事局（市外国专家局）

四、实施说明：

本项行政许可在聘请外国文教专家的单位实施，包括教育、新闻、出版、文化、艺术、卫生、体育等单位；其他单位暂不实施。

外国文教专家是指在教育、新闻、出版、文化、艺术、卫生、体育等领域工作的外籍专业人员，包括外籍教师、外籍管理人员、外籍教练、外籍乐队成员等。

凡聘请外国文教专家3个月以上，向对方支付工作或劳动报酬的均须资格认可。

五、申请条件：

凡拟聘请外国文教专家的单位，均须获得“聘请外国专家单位资格认可”，并取得《聘请外国专家单位资格认可证书》。该证书是办理《外国专家来华工作许可证》、《被授权单位签证通知表》、《外国专家证》及《外国人居留许可》的基本证明。

申请“聘请外国专家单位资格认可”的单位，需具备如下条件：

（一）具有独立法人资格；

（二）经过行业资质认可；

（三）设有外国专家管理和服务工作的专门机构，配备具有良好业务素质的工作人员；

（四）外国专家管理制度和外事工作人员制度健全；

（五）具有聘请外国专家所需的工作条件、生活设施和安全保卫能力；

（六）具有聘请外国专家所需的经费保障。

新开办的学校及其他教育、培训机构，应运行1年以上，在教师、生源和教学秩序基本稳定后，方可申办资格认可。但正式设立的中外合作办学单位和专门招收外籍人员子女的学校，不受此限。

高等院校、学校、幼儿园及其他机构中凡具独立法人资格的二级单位或分院（校），均须单独申办资格认可。

六、申报材料：

（一）《聘请外国专家单位资格认可申请表》（可从下载）；

（二）法人资格证书复印件；

（三）外国专家管理制度（包括安全制度）；

（四）聘请单位外事人员工作制度；

（五）行业许可证书或证件复印件：学校和其他教育、培训机构，提交教育、劳动或工商行政部门办学批复、《办学许可证》或《营业执照》复印件；其他单位，提交相关行政部门签发的业务许可证书或批复文件的复印件；

注：

1.各聘请单位须按隶属关系由行业主管部门在《聘请外国专家单位资格认可申请表》“行业主管部门意见”栏中出具意见后，将材料报大连市外国专家局。无行业主管部门的聘请单位可将申请材料直接报送大连市外国专家局。

2.以上材料均1式5份。

七、办理程序和期限：

（一）申请

单位向市人事局（市外国专家局）提出申请。

（二）受理

1.对申请材料齐全、符合法定形式的，予以受理。

2.市人事局（市外国专家局）允许申请人当场更正其申请材料中的错误；对申请材料不齐全或者不符合法定形式的，应当场或在5日内出具《补正申请材料通知书》，一次告知申请人需要补正的全部内容，逾期不告知的，自收到申请材料之日起即为受理。

3.对受理或者不受理的申请，市人事局（市外国专家局）出具《受理通知书》或《不予受理通知书》。对不予受理的申请，注明不予受理的理由。

（三）审查

市人事局（市外国专家局）审查聘请单位递交的申请材料，认为需要对申请材料的实质内容进行核实的，可会同行业主管部门或单独组织实地核查（至少指派2名以上工作人员，核查所需时间不超过10个工作日）。市人事局（大连市外国专家局）加具审查意见，将申请材料和征求意见表一并报送辽宁省人事厅（辽宁省外国专家局）。

市人事局（市外国专家局）将根据省人事厅（省外国专家局）的年检通知组织年检，于每年12月15日之前向省人事厅（省外国专家局）提交本市的年检报告，省人事厅（省外国专家局）汇总核实后于12月底前向国家外国专家局提交我省的年检报告。国家外国专家局于每年1月1日至1月31日对所有获得资格认可的单位进行年检，根据不同情况，分别作以下处理：

（一）对正常开展聘用工作的单位，准予注册（即资格认可继续有效）；

（二）对聘用管理过程中出现一般性问题或1年内未正常开展聘请工作的单位，暂缓注册（即暂停资格3个月，3个月后视发现问题解决情况，决定准予注册或吊销资格）；

（三）对因取消、合并等原因不再聘请或连续2年未聘请外国专家的单位，注销聘请资格；

（四）对聘用中出现严重问题的单位，吊销聘请资格，2年后方可重新申请。

九、其他事项：

（一）此前已批准获得《聘请外国文教专家单位资格认可证书》并通过2007年年检注册的资格认可证书继续有效。

（二）各单位所聘请的外国文教专家，在向市公安局出入境管理部门申请《外国人居留许可》时，均须以《外国专家证》作为身份证明。如专家未获得《外国专家证》和《外国人居留许可》而受聘，市人事局（市外国专家局）将在每年年检时，视情节轻重建议国家外国专家局暂缓注册或吊销该单位的《聘用外国专家单位资格认可证书》。

（三）凡没有获得聘请外国文教专家单位资格认可的单位，如擅自聘请外国文教专家，市人事局（市外国专家局）将会同大连市公安局和相关行业主管部门进行查处。
