复旦法律硕士复试情况

汇总一下，高分组基本不刷人，面试气氛比较和谐，有时也会刻意刁难你，杀杀你的傲气，比如A1组第二个姐们被逼问劳动人民与人民的区别，私认为没区别啊，于是老师得出结论：书看的不多啊。B1有问到法制史里面王安石变法的，这个偶们课本上没有，据说一位本科学历史的仁兄跟老师谈了半小时历史知识。有学国贸的被问到国贸流程，答的不好也没事，老师补一句，“其实我也不清楚哈”，笑笑就过去了。还有传说面到下午老师犯困之际，一个本科学产品质量什么的仁兄把老师惊醒，那老师说我有个课题搞产品质量法的，回头留个邮箱帮我搞课题。问言论自由的时候一位仁兄很有爱的说我誓死捍卫各位老师您说话的权利，然后大侃宋祖德。还有个“恶毒”的老师对一个女生说你头发挺好的，如果买你的头发能不能成立民事行为呢，其实问的是民法上物与物理上物的差别，头发只有剪下来独立于主体才能成为民法上的物哈。还碰到一个上海大学的女生说她明年考，今年来现场取经的，这小孩据说虽然提前考，但还是华成法硕培训班总分前几名的学员，挺牛的。

高分组主要考查你的临场反应，看你知识面广不广，像我被问到最新的刑8的内容，还涉及legal English,这些都是课本上没有的，比较发散，还好之前扫了几眼刑8看了几个单词，只要不紧张的说不出话都问题不大。低分组兄弟姐妹们确实会遭遇各种不幸了，对半刷人，一个女生说被问到如果一个小伙子撞到一个老奶奶需要赔偿医药费但他确实没钱怎么处理？她愣了半天说不知道然后出来看到老师在她名字那画圈，估计被刷了。这个我回来查出处是今年二月发生的一个案子，一个18岁小伙子撞了老奶奶没钱赔最后自杀了，小伙子父母反告老奶奶家逼死他儿子。看来多看点法制在线是有好处的。其实复试要说经验的话低分组杀出重围的同胞们最有发言权，高分组面试像走过场哈。

最后来夸夸复旦的法学院，去之前就知道有这么个说法，复旦法学院是全亚洲最豪华的法学院，来到江湾才知道确实是豪华。复旦的格局是一体两翼，杨浦的邯郸与江湾连成一体，徐家汇的枫林校区与浦东的张江校区是两翼。复旦的魂在杨浦在本部邯郸校区，江湾也在杨浦，离本部10来分钟公交的样子，挺近的，能看到本部高耸的双子楼，只是有点小偏。从本部坐168路公交先经过五角场那片沃尔玛、巴黎春天市区再经过五分多钟路边没房子没店面只有花草树木和10

号地铁站的公路就看到江湾了，江湾像一座欧式庄园，掩盖在公路两旁的花草树木中，如小世外桃源般宁静。法学楼的大厅我总觉得可以用来办舞会，欧式庄园里达西家的舞会，伊丽莎白拖着坠地长裙从楼梯款款走下来，美美滴。

江湾有两个湖，日湖和月湖，本部有光华楼，连起来是“日月光华”，“复旦”二字出自《尚书》名句“日月光华，旦复旦兮”，最初我也是对这八个字一见钟情吧。之前在论坛上看到复旦学长写的文，说复旦是东方的耶鲁，耶鲁最好的是法学院，复旦最好的是老牌文史哲、数理化，法学只是中等水平，而法学却是目前复旦重点发展对象，一级学科刚批下来，09年刚80周年院庆，廖凯原法学楼貌似不是用来上课的，只是法学院的办公室、研讨室、会议室什么的，真是奢侈。法学楼门口蹲着两尊大石狮，其中一个石狮上刻着2001级JM某某人赠，01级的04年才毕业，我说毕业五年就这么有钱了？

结束一段旅程，考研的日子算是终于画上句号了，回家休养生息，美好的人间四月天，life is wonderful。感谢法硕联盟论坛，感谢曾经帮助过我的朋友们。搞实习报告，写毕业论文，五月份回校，好好规划我的未来三年。边走边看，这一路的风景，勇往直前！

法律硕士联考小贴士：

一、法律硕士分类

法律硕士联考目前分为三种：全日制法律硕士【法律硕士（非法学）及法律硕士（法学）】和在职法律硕士。

法律硕士（非法学）：只允许本科专业是非法学的考生报考，是法律硕士联考的主力军。如果本科学位发的是法学学士，但是专业不是招生简章明确规定的13个法学专业，也是可以报考法律硕士（非法学）的。这里的非法学，只是限定了专业，而没有限定学位。学制一般是三年。

法律硕士（法学）：2009年开始设置的，面向本科是法学专业的考生招生。学制两年。

在职法硕：也就是10月在职研究生联考。俗称“五部委联考”，参加在职法硕考试的一般是公检法的在职工作人员。

二、法律硕士考试科目

全日制法律硕士考试科目如下：

政治（100分），英语（100分），专业课一（150分）刑法和民法，专业课二（150分）宪法，法制史，法理学。总分500分。

政治和英语和全国所有的研究生考试是一样的，命题和阅卷也是和全国研究生考试统一的。其中，英语，法律硕士考察的是难度大一点的英语二。

在职法律硕士考试科目如下：

英语，专业课。在职法硕初试不考察政治，政治的考察由招生院校在复试的时候单独设置。

三、法律硕士用书

法律硕士都有指定的教材。就是高等教育出版社的法律硕士考试分析及人民大学出版社出版的法律硕士指南。

现在市面上也有一些杂牌书籍，不少也是冠以指南或者考试分析的名目出版。不建议大家购买，因为其质量参差不齐，更有一些书籍虽然是出版的，但很多低级错误或者是观点和官方的不一致。

建议大家购买官方书籍。如果觉得法律硕士指南或者考试分析内容太多，不利于理解，大家可以去购买或者下载华成法硕讲义，该套讲义完全依照最新的法律硕士考试大纲和官方书籍编辑，观点和官方完全一致，华成法硕讲义只是对官方的书籍进行的梳理，对书中的难点知识进行了归纳和总结，并制作了大量的口诀和记忆表格，方便大家记忆。

四、法律硕士重要时间

1.法律硕士招生简章出台时间

法律硕士招生简章由国家的招生简章和各个招生院校的招生简章。

国家的法律硕士招生简章一般是每年的8月份出来，各个法硕招生院校的招生简章一般是7月至9月中旬出来。招生简章是我们考试的指挥棒，里面对学校有关法律硕士的考试，培养模式，招生人数，学费，复试时间及参考书目都有详细的说明。

2.法律硕士报名时间

考研报名分预报名、正式报名。

预报名时间：预报名是针对应届生的，时间一般是9月25至9月29（虽然预先报名作用不大，但建议大家还是花时间去看看，了解一下网报流程。）正式报名时间：正式报名一般是10月10至10月31

3.法律硕士报名现场确认时间

现场确认时间：现场确认确认时间是11月10考试

4.法律硕士考试时间

法硕考试时间一般是春节前2周进行，大家关注每年什么时候过春节，往前推半个月时间大致就能知道考研时间是哪天。

法律硕士考试进行两天，第一天上午考政治，第一天下午考英语，第二天上午考专业课一，第二天下午考专业课二。

5.法律硕士出分时间

自主划线的学校处分时间早，一般是2月份就陆续会发布自己学校的分数线。非自主划线的学校的分数线一般都需要等待国家线出台才能呢个发布自己的分数线，国家线一般是每年的3月底出来。

6.法律硕士复试时间

自主划线的学校复试时间早，一般在3月份就开始了。而非自主划线的学校，一般都是在4月份进行复试，教育部要求所有的学校在4月底必须把复试工作完成。

浙江大学的法律硕士复试经历

31号是复试时间，28号我坐上前往杭州的火车，经过近20个小时的颠簸终于到达了杭州，下火车的第一感觉就是热，估计要有30度了，自己一路上把秋衣都脱掉了，还是很热。坐出租到达了浙江大学西溪校区，估计是浙江大学最不怎么样的校区了，找到宾馆住了下来，140元一天，房间小的很，设施很差，不能洗热水澡的，不过好歹有电视和空调。

安顿下来后准备好好吃一顿的，人人都说天堂杭州有三美，美食，美景，美女。走在校园里远远看见一个女生就会想看看是不是美女，呵呵，不过好像没有想像中的那么多的，出了校门走了一段路遇到饭店招揽生意的小姐，先生长先生短的弄的我不好意思走了，说欢迎光临好像什么日月餐厅，问我是去日光餐厅还是月光餐厅，我心想我一向光明磊落，那就进日餐厅吧，有些别扭，呵呵。进去后很是干净，点了几个菜，早就听说西湖的鱼不错，又要了一条鱼，一开始要桂鱼的，后来服务员来说一条2斤多，吃不了，我还挺激动，心说看人家这里就是素质高啊，还这么关心这个，后来我说那黄鱼吧，菜上来了，我都无语了，东西少的可怜，盘子本来就是不打的，还半个盘子是一朵茴香装的花„„茄子是条的，皮很硬，豆角一盘子就几十根，要了个春笋，因为这里的特产，很正宗的，结果有些苦，最后我的鱼终于上来了，很是单薄，我都不忍心吃人家，没有想像中的那么好吃的，最后也没有吃饱，我结帐时竟然是267元„„我都无语了，不情愿的把钱付了，现在想起来还心疼，原来在天津上学不觉的，现在才知道天津吃饭是那么的好。

30号上午我体检完毕后我准备去西湖看看，出门打出租车，竟然死活打不到，都有人的，打出租车竟然等了半个小时，要是我在天津一招手还不呼啦来一大片„„西湖离的不远，不收票的，其实想收也办不到的，西湖周长30里，拦不住的，呵呵，我来得正是好时候，西湖边桃花都开来，特别美丽的，我围湖走了2个多小时，看到了雷锋寺，苏小小墓等等，景色很不错，中午买了盒饭外加一瓶啤酒，花了20远，米饭硬的不得了，菜就是一些白菜，豆腐和一块小排骨。吃的我完后胃疼了半天。最后实在有些走不懂了上了观光车，30元坐了大概半小时。后来打的回宾馆了，晚上终于找到了一家饺子店，进去后鲜肉韭菜的一份6块钱15个，我瞥了一眼一个女生吃的饺子，真小„„我说来来两份，饺子上

来后，旁边的人还直看我，好像说我竟然吃这么多„„我晕，我在北方绝对算不上能吃的，我心想叫我宿舍的同志过来一个人还不能你四份。

31号上午我在宾馆里看看书，忍不住就上了我喜欢的法硕联盟论坛，网上复试通知说的是只有面试的，一个人十几分钟，并且说自己介绍自己熟悉的领域

[民法，刑法，经济法，法理„„]都可以的，由相关老师进行提问，我准备选法理，因为民法，刑法什么的问题太活的，容易被追问，经济法就更不要说了，没有学过。下午一点半到了复试点，有很多同学了，我排号19位，因为浙江杭州本地的被抽调了到了明天，所以我也就是第10来个。下午一点半开始的，出来一个人大家就呼的围上去问，弄的外面的老师老师叫我们安静点，根据出来的同学说的问题大概就是英语先和老师对话，基本上不是叫你自己介绍，之后再问你专业的问题，而且大多数人都把通知理解错误了，其实不是叫你介绍一个领域然后老师就这个领域提问，是想起哪个问哪个，并且可能涉及好几个部门法的。有个学生出来后我记得紧张的都说不出话来了，缓了半天才说老师问了他一个案例，说一个人已经判死刑，法院已经公告了，还有一个人之后在大街上到处发关于死刑犯的传单，犯不犯法？还有问就“文化大革命好，真好，就是好”发表一下看法，还有“什么是善意”答案应该是不知情，还有问国内法和国际法的区别，最近颁发了什么法规，对于浙江大学上课安装摄象头怎么看？大陆法系和英美法系的区别，一般都是先问你一个问题，在你回答的时候进行追问，我前面的同学进去后我在门口紧张的等着，半天不出来，估计是因为我下一个，所以觉得时间很慢。终于他出来了，我进去后，就觉得满屋子的人，我轻轻的关上门后转身上前几步后鞠躬70度说老师们好，然后一个老师把我的资格审查证明收取后叫我坐到一张孤零零的椅子上，我面对着十几个老师，最右边有三个记录的学生。我坐下后一个老师说现有某老师考察一下你的英语能力，之后旁边一个很和蔼的老师用英语问我从哪里来，在那里出生的，大学，专业，对今后的计划什么的，我回答的比我想象的好，那个老师和我对话时还经常笑，对我还算满意，大概问了2，3分钟的样子，之后最左边的一个老师问我采用以公司制进入市场对我国经济有什么好处„„我心想晕，超纲了„„说有利于促进我国经济发展，老师说还宏观了，我说公司有独立的人格，旁边一个老师问难道自然人没有？我说有，有„„不过法人是一个组织，说了法人的定义，又说采用公司制可以使出资人规

避风险，使更多的人进入市场什么的，最后那个老师说你不会也没有事情，这个你没有学过。我当时有点蒙了，一个老师又问那法人可以犯哪些罪，我说非法集资罪等，主要是集中在经济类犯罪的领域，有问了我对法人的处罚原则，之后问我洗钱罪能不能法人犯罪？我说能，老师说好，说一说什么是洗钱罪，我当时紧张是肯定的了，背的发条根本就是堵住脑子里出不来，我说说白了就是把非法的资金批上合法的外衣，老师说那你说一下它的犯罪构成，我有些磕巴的说完后，又问我看过“反洗钱法”没有？我没有看过的，但是当时想也没有想，就说看过！说完后我还后怕，老师有些不相信的说“你看过？”我心说完了„„说错话了，我心想算了，也别给你问我的机会了，我说“恩，看过的，关于其犯罪的客观方面的行为有四个„„最后又新加了三个„„”老师点了点头，后来就是很可怕的静场„„老师们都低着头，最后终于一个老师抬起头来问记录的同学几个问题了，回答说四五个了，老师说可以了，这时最中间的一个老师抬起头说，那我再问你最后一个问题，就是你对于法伦工怎么看？我说坚决反对！老师点了点说可以出去了，大概也就是10来分钟。

4月2号，我打电话过去询问，说被录取了，呵呵我才终于舒了口气，告戒大家其实复试你用的时间越短说明你越有戏的，有的问了半个小时，那是老师门想挽救他才问他很多的，多半就悬了。老师们都很和蔼，并且浙江大学复试我感觉是很公平的，所以希望大家也能报考了。感谢曾经帮助过我的老师，感谢华成法硕的胡老师，感谢为我复试提供信息的战友们。

法律硕士联考小贴士：

一、法律硕士分类

法律硕士联考目前分为三种：全日制法律硕士【法律硕士（非法学）及法律硕士（法学）】和在职法律硕士。

法律硕士（非法学）：只允许本科专业是非法学的考生报考，是法律硕士联考的主力军。如果本科学位发的是法学学士，但是专业不是招生简章明确规定的13个法学专业，也是可以报考法律硕士（非法学）的。这里的非法学，只是限定了专业，而没有限定学位。学制一般是三年。

法律硕士（法学）：2009年开始设置的，面向本科是法学专业的考生招生。学制

在职法硕：也就是10月在职研究生联考。俗称“五部委联考”，参加在职法硕考试的一般是公检法的在职工作人员。

二、法律硕士考试科目

全日制法律硕士考试科目如下：

政治（100分），英语（100分），专业课一（150分）刑法和民法，专业课二（150分）宪法，法制史，法理学。总分500分。

政治和英语和全国所有的研究生考试是一样的，命题和阅卷也是和全国研究生考试统一的。其中，英语，法律硕士考察的是难度大一点的英语二。

在职法律硕士考试科目如下：

英语，专业课。在职法硕初试不考察政治，政治的考察由招生院校在复试的时候单独设置。

三、法律硕士用书

法律硕士都有指定的教材。就是高等教育出版社的法律硕士考试分析及人民大学出版社出版的法律硕士指南。

现在市面上也有一些杂牌书籍，不少也是冠以指南或者考试分析的名目出版。不建议大家购买，因为其质量参差不齐，更有一些书籍虽然是出版的，但很多低级错误或者是观点和官方的不一致。

建议大家购买官方书籍。如果觉得法律硕士指南或者考试分析内容太多，不利于理解，大家可以去购买或者下载华成法硕讲义，该套讲义完全依照最新的法律硕士考试大纲和官方书籍编辑，观点和官方完全一致，华成法硕讲义只是对官方的书籍进行的梳理，对书中的难点知识进行了归纳和总结，并制作了大量的口诀和记忆表格，方便大家记忆。

法律硕士招生简章由国家的招生简章和各个招生院校的招生简章。

国家的法律硕士招生简章一般是每年的8月份出来，各个法硕招生院校的招生简章一般是7月至9月中旬出来。招生简章是我们考试的指挥棒，里面对学校有关法律硕士的考试，培养模式，招生人数，学费，复试时间及参考书目都有详细的2.法律硕士报名时间

考研报名分预报名、正式报名。

一、复旦大学简介
